1. Service Scope and Nature of Outputs

DINPanel is a software tool that assists with electrical planning workflows, documentation, and process support.

Any validation, calculation, recommendation, warning, or generated output provided by the Service is informational and suggestive only.

• DINPanel does not provide engineering sign-off or professional certification.
• DINPanel does not guarantee that generated circuits, designs, or documents are correct, complete, safe, compliant, or fit for any specific purpose.
• You must independently verify all outputs before procurement, installation, commissioning, or submission to any authority.

2. Professional Responsibility and Compliance

Full responsibility for technical decisions, design correctness, site execution, safety, legal compliance, and final documentation remains solely with the user and/or the executing contractor.

At this time, DINPanel does not declare, warrant, or certify compliance with national or international electrical standards, codes, or regulations.

• You are responsible for compliance with all applicable laws, standards, and local utility/operator requirements.
• You are responsible for ensuring work is performed by properly qualified and authorised personnel.

3. No Warranty

The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law.

DINPanel disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

4. Limitation of Liability

To the maximum extent permitted by law, DINPanel and its affiliates, officers, employees, and contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to use of the Service.

This includes, without limitation, site failures, electrical faults, safety incidents, design defects, delays, downtime, data loss, procurement errors, rejected approvals, or commercial losses.

• Where liability cannot be excluded by law, it is limited to the amount paid by you for the Service in the 12 months preceding the event giving rise to the claim.

5. Indemnity

You agree to indemnify and hold harmless DINPanel against claims, liabilities, losses, and expenses (including legal fees) arising from your use of the Service, your project outputs, your breach of these Terms, or your violation of applicable law.

6. Fair Usage Policy

You must use the Service in good faith and in a manner consistent with reasonable technical and operational limits.

• No abusive automation, scraping, credential sharing, or attempts to bypass limits or security controls.
• No intentional overload, denial-of-service behaviour, or use likely to degrade performance for other users.
• No unlawful, fraudulent, or safety-critical misuse of generated outputs.

7. Data, Security, and Availability

You are responsible for the legality and accuracy of data you submit. You should maintain your own backups and internal quality controls.

DINPanel may perform maintenance, updates, and security actions that can affect availability.

• DINPanel does not guarantee uninterrupted operation, error-free performance, or permanent data retention.

8. Intellectual Property

All rights in the Service, software, branding, and related materials remain with DINPanel and its licensors.

Subject to your compliance with these Terms, DINPanel grants you a limited, non-exclusive, non-transferable right to use the Service.

9. Suspension and Termination

DINPanel may suspend or terminate access where necessary for security, legal compliance, non-payment, abuse, or breach of these Terms.

10. Changes to Terms

DINPanel may update these Terms from time to time. Continued use of the Service after updates take effect constitutes acceptance of the updated Terms.

11. Governing Law

Unless mandatory law requires otherwise, these Terms are governed by the laws of Poland.

13. Referral Program

DINPanel may offer a referral program under an active campaign configuration shown in the Service. Campaign parameters can include referral window, percentage rates, bonus caps, and eligibility constraints.

Referral bonus events are created based on actual paid amounts from qualifying transactions and are credited first as pending before unlock.

• Each user may have one referral link/code. Self-referral is not allowed.
• A referred account can be linked only once; first valid referral assignment wins.
• Referral bonuses unlock after a defined pending period (currently 15 days from source payment) and may be cancelled or revoked if source-payment conditions are not met.
• If a source payment is refunded or charged back (including partial refund/chargeback), related referral bonuses may be cancelled or revoked.
• Revocation applies only to unspent referral bonus remainder and does not create negative wallet debt.
• Bonus percentages and caps are governed by the active campaign and may change for future referrals or future qualifying payments.
• Referral bonuses are promotional wallet credits for Service use and are not guaranteed cash payouts unless mandatory law requires otherwise.
• DINPanel may change, suspend, or terminate the referral programme (in whole or in part) at any time, including without cause, subject to mandatory applicable law.
• DINPanel may also suspend, limit, or terminate participation of a specific user in cases of abuse, fraud risk, policy breach, or legal/regulatory requirements.
